Terms of Service
Last updated: 2026-11-04
Motiarc (motiarc.com, “the Service”) is provided by TREKX LLC, a Wyoming limited liability company (“we”, “us”). We also provide LaunchFlim (https://launchflim.com); the two share accounts, workspaces and subscriptions. By using the Service you agree to these Terms. If you use it for a company or team, you confirm you may bind that organisation to them.
1. The Service
You talk with Cue, an AI producer; Cue reads the URLs and material you give it and turns the film you want into a brief. Once you confirm the brief, the Motiarc engine (processed by third-party AI models) makes the film from it and delivers it to you. The Service remembers your product and brand (product memory), so the next film does not start from nothing. Features may change or be withdrawn at any time.
2. Cue is an AI
Cue is an AI producer, not a person: you are talking with a third-party AI model (see the Privacy policy). The films are made by an AI engine too. Cue’s answers, the brief it writes and the films can be wrong or unsuitable: check the brief before you confirm it, and review a film before you publish it. You are responsible for what you publish.
3. Accounts
- You must be at least 18, or of legal age where you live.
- You sign in with Google; you are responsible for everything done with your account and for keeping your sign-in secure.
- A workspace’s owners manage its members and payments; members use its content according to their role (owner, editor, viewer).
4. Your content
The URLs you provide, what you write in conversations, and the images, videos, PDFs, fonts, logos and text you upload (“your content”) remain yours. You confirm that:
- you own the brand and product concerned, or are authorised to use its brand, screens and material;
- your content does not infringe anyone’s copyright, trademarks or other rights;
- your content contains no one else’s personal data or recognisable likeness unless that person agreed;
- conversations and material contain no real customers’ data, passwords or keys.
You license us to store and process your content as needed to provide the Service (including keeping it as product memory for your later films), to make films from it, and to pass it to the processors that help provide it (such as AI model providers — see the Privacy policy). This licence ends when the content or your account is deleted; backups are cleared on their own schedule.
5. Your films
You may use the films made from your content freely, including commercially. The Service’s engine, templates, interface, music and code remain ours.
6. What you may not do
- anything unlawful, infringing, impersonating or misleading;
- ask Cue to read sites you have no right to use, or give it other people’s private data from behind a login;
- interfere with or get around the Service’s limits (monthly allowances, access controls), or access it in bulk by automation;
- upload malware or try to reach data that is not yours.
We may remove such content and suspend or close the account concerned.
7. Subscriptions and monthly allowances
- Motiarc is open to workspaces on LaunchFlim’s Standard or Pro plan. That subscription is LaunchFlim’s (the same Stripe account and the same prices), whether you subscribe on Motiarc or on LaunchFlim.
- Prices are in US dollars; tax for your region is added. Payments are handled by Stripe (where applicable, Stripe’s Link may act as the reseller and issue the receipt); your card statement shows LaunchFlim.
- Each plan month includes: on Standard, 1 film and 5 new conversations; on Pro, 3 films and 15 new conversations. The plan month runs from your billing date (a yearly plan resets monthly too); what is unused does not roll over, and there are no add-ons.
- A film counts in the plan month you confirm its brief (or start it again after it failed); a film that fails is not counted, and counts once more only when started again. A new conversation counts when it starts.
- Subscriptions renew automatically until you cancel. You can cancel any time from Motiarc’s Plans page (Manage subscription) or in LaunchFlim’s Settings → Plan & usage → Manage billing and invoices; the plan runs to the end of the period, nothing more is charged, and no new conversations or films can be started after it ends — films already delivered stay in your library.
- An upgrade starts at once and the difference for the rest of the period is charged then; a downgrade starts at the end of the period.
- We may change prices or monthly allowances; a subscription’s new price is announced in advance and applies from its next renewal.
8. Refunds
See the Refund policy. Except where the law requires otherwise, payments are not refundable.
9. Ending the agreement
You can ask us at any time to delete your account and your Motiarc data (see the Privacy policy). We may suspend or end your use for a breach of these Terms, where the law requires, or if we stop operating the Service; if we end a paid subscription because the Service stops, we refund the unused part of its period pro rata.
10. Disclaimer
The Service is provided “as is” and “as available”. To the extent the law allows, we do not promise that it will be uninterrupted or error-free, or that it will achieve any particular marketing or business result.
11. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages (including lost profits or data), and our total liability for the Service is limited to the amount you paid us in the 12 months before the event.
12. Governing law
These Terms are governed by the laws of the State of Wyoming, USA, and disputes about them or the Service go to the courts of Wyoming. Mandatory consumer protection rules where you live are not affected.
13. Changes
We may update these Terms and will change the date on this page; we give reasonable notice of material changes before they apply (for example by e-mail or in the Service). Using the Service after a change applies means you accept it.
